Terms of Use

1. Agreement

These Terms of Use govern your access to and use of the CareGuide website, patient portal, and mobile apps (the “Service”). By creating an account or using the Service, you agree to these terms and to our Privacy Policy. Clinicians using CareGuide’s professional tools are additionally bound by the clinician Terms of Service presented at sign-in.

2. CareGuide is not medical advice

The Service provides general education based on your surgeon’s rehabilitation protocols and published research. It is not a medical device and does not provide medical advice, diagnosis, or treatment. It does not replace your surgeon, physical therapist, or any other clinician. Always follow your care team’s specific instructions, and consult them before changing anything about your recovery.

If you think you are experiencing a medical emergency — including chest pain, trouble breathing, or thoughts of self-harm — call 911 (or your local emergency number) immediately. Do not rely on this product.

3. Eligibility and accounts

  • You must be at least 13 to use the Service; if you are under 18, use it with a parent or guardian.
  • Keep your password confidential — you are responsible for activity under your account.
  • Give accurate information, including when logging check-ins your care team may review.

4. Acceptable use

You agree not to:

  • Use the Service for anyone’s medical care in place of professional judgment.
  • Probe, disrupt, or overload the Service, or access it by automated means without permission.
  • Attempt to access another user’s account or data.
  • Reverse engineer, resell, or misrepresent the Service or its answers.

5. Your content

You own the information you submit. You grant us the license needed to operate the Service — to store your questions and check-ins, show them to you and your linked care team, and maintain required audit records. We may use aggregated or de-identified data to improve the Service.

6. Intellectual property

The Service, including its software, design, and content (other than your content and your care team’s protocols), belongs to CareGuide and its licensors. These terms don’t grant you any rights to our trademarks or other IP beyond using the Service as intended.

7. Disclaimers

The Service is provided “as is” without warranties of any kind, express or implied, including fitness for a particular purpose. AI-generated answers can be incomplete or incorrect; sources are cited so you and your care team can verify them. We do not warrant that the Service will be uninterrupted or error-free.

8. Limitation of liability

To the maximum extent permitted by law, CareGuide will not be liable for indirect, incidental, special, consequential, or punitive damages, or for any loss arising from reliance on information provided by the Service. Our total liability for any claim relating to the Service is limited to the greater of $100 or the amount you paid us in the twelve months before the claim.

9. Termination

You can stop using the Service or delete your account at any time. We may suspend or terminate access that violates these terms or puts the Service or its users at risk. Sections 2 and 5–8 survive termination.

10. Changes

We may update these terms as the Service evolves. We will post changes here and update the date above; material changes will be announced in the Service. Continuing to use the Service after changes take effect means you accept them.

11. Governing law

These terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Delaware.
